Terms of Service

A Secret Book (from here abbreviated as ASB) provides services that enable people to share their stories with the community by pseudonym names or nicknames. The Terms govern how you should use ASB in the right ways.

We don’t charge you to use ASB in the ways covered by these Terms, or we state otherwise. By using ASB, you agree that we can show you ads.

For your privacy when using ASB, we don’t collect your personal information except for your email and country. We don’t sell and share your email address with other third parties unless you give us specific permission. Instead, people may find you in their ways. Our Privacy Policy explains how we collect and use your personal data.

You have the right to log out of ASB after using it. Otherwise, we keep you logged in within 7 days. If you don’t use ASB within 7 days, the system will log you out of ASB.

1. The services we provide

Our mission is to give people the opportunity to release their thoughts and feelings that are hard to disclose in front of others at a specific period of time or long term. To do that, we provide the services described below:

Empowering you to express and release your thoughts and feelings to help you get a better mood:

There are several ways to express your thoughts and feelings on ASB, for example, writing a story with only words or emojis, sharing a person's story, updating an avatar or chatting with other people.

Connecting you with other people who you may find interesting or have similar perspectives to you or people you want to follow:

When you see people you feel happy or unhappy with their stories, you can interact with them by giving them a Happy or unHappy reaction. Also, you can share their stories in your secret book. Besides, you can follow them and see their stories without knowing exactly who they are. You can send them a chat request. If they accept your chat request, you can chat with them. Otherwise, you can't. Moreover, you can block or unblock people you are chatting with so they cannot send you a message. The block function is only applied to the Chat section. We also provide a separate tab showing only the people you follow. ASB displays stories automatically in the same country as you. You also can search specific users without limiting the country area. For example, the system automatically provides stories in Australia if your registered country is Australia. However, to find people outside of Australia, you should know their nicknames, such as Lion King, and you may get this user in the US or Canada. Besides, you can comment on other posts and receive notifications on your posts and the posts you have engaged.

Providing you with a personalized nickname:

After completing the registration successfully, ASB gives you a random pseudonym. We allow you to select a custom name. Choosing this name can help you satisfy yourself with another pseudonym or nickname that may not be the same as your real name. Each custom name is unique across the country you register with a string length of 12 characters. Because it's unique, no one can choose the same name as yours within a country and it's free.

Maintaining and improving our services' safety, security and integrity, fighting harmful conduct to keep our ASB community safe:

People use ASB if they find it safe and secure. We work very hard to maintain the security of the services we provide to you. With the main aim of helping people release negative emotions towards positive and good behaviour, we always try to ensure the safety and comfort of the ASB user community when using our services. We will work with relevant parties if we detect practices in the misuse of ASB users that are potentially harmful to our community. If we find some such behaviour, we will take appropriate actions to protect the community, such as sending you email notifications, offering help, removing inappropriate content or blocking your account.

2. How our services are funded

We do not charge you for using ASB's services covered in these Terms. Instead, you agree to us being able to show you advertisements that companies and organizations pay us to promote their products and services.

We do not collect any of your information when you click on advertisements. We only count the number of clicks on the ads to report to companies and organizations.

3. Your commitments to A Secret Book and our community

We provide these services to you and others intending to help us fulfil our mission best. In return, we need you to commit to the following:

3.1. Who can use ASB

Our community becomes safer and more accountable when people agree with their opinions and actions. Therefore, to use ASB, you must:

- Provide accurate email and verify it before using ASB.

- Create only one account and use it for personal purposes, or we state otherwise.

- Not share your password, give access to your ASB account or transfer your account to anyone else.

You cannot use ASB if:

- You are under 13 years old.

- You are a convicted criminal.

- You have been blocked previously for your violations of our Terms and Policies. If we disable or block your account because of violating our Terms and Policies, you agree not to create another account without our permission. Allowing you to create another account is our sole decision, and it does not mean or imply that the disciplinary action was wrong or without cause.

You are strictly prohibited from using ASB to distribute, propagate, and promote programs, actions, and behaviours that affect Australia's political, religious, cultural and social regimes and other countries.

3.2. What you can do on ASB

We encourage people to use ASB to express their thoughts and feelings, which can help them get a better mood, but not at the expense of the safety and well-being of others or the integrity of our community. Therefore, you agree not to engage in the conduct described below (or to facilitate or support others in doing so):

- Use ASB to post or share things that violate our Terms and Policies.

- Do things that are unlawful, misleading, discriminatory or fraudulent (or assists someone else in using ASB in such a way).

- Own or have the necessary rights to share.

- Infringe or violate someone else's rights even though you do not know exactly who they are.

- Use ASB services to send spam or do anything else that could disable, overburden, interfere with, or impair the proper working, integrity, operation, or appearance of our services and system.

- Access or collect data from our services and systems using automated means (without our prior permission) or attempt to access data you do not have permission to access.

- Proxy, request, or collect ASB usernames or passwords or proactively apply misappropriate access tokens.

- Sell, license, or purchase any data obtained from us or our services, except with our permission.

We can remove the content that is a violation of these provisions. We’ll let you know and explain any options you should take to avoid violating these Terms. Also, if we remove your content or deactivate your account, we’ll let you know the reason.

We encourage you to report content or any harmful conduct that you believe violates your rights, our terms and policies by going to the account you want to report, clicking the "..." sign, and then clicking the "Report" button to report that account, or we state other ways to report.

4. You give us the permissions

To deliver our services to you best, you agree to give us your permissions on the followings:

Use the content you create and share to take appropriate actions needed to protect ASB users and our community.

Your content will not be shown to others if you have deactivated yourself, including stories, shares, followings, comments and reactions. However, your messages with other people will remain in their chats. No user can find you in ASB.

If you delete your account, all the content you create, reactions, followings, comments and messages will be deleted, and you cannot recover them. Also, no one in ASB can find you.

Use your email and country details.

We will use your email to communicate with you and take the appropriate actions to protect you, other ASB users and our community.

Update the software you use or download.

If you use our application, you give us permission to download, update and install the software where and when available.

5. Additional provisions
Updating our Terms

We may need to update these Terms from time to time to accurately reflect and improve our services for you to get a better experience on ASB. We'll notify you via email for at least 30 days when there's an available update. When the new Terms are in effect, you will be bound by them if you continue using ASB.

Suspending and terminating account

We want ASB to be a safe and secure place where people can share their thoughts and feelings. If we find out that you violate or breach our Terms or Policies, we may suspend or terminate your access to the ASB account. We may delete your account if you don't activate your account after registration for 12 months.

Disputes

Any claim, cause of action, or dispute you have against ASB, you and ASB agree that any such claim, cause of action or dispute must be resolved exclusively in the Australian Court. You also agree that you submit to the personal jurisdiction of the courts to litigate any such claim and that the laws of Australia will govern these Terms and any claim, cause of action, or dispute without regard to conflict of law provisions. Without prejudice to the preceding, you agree that, in its sole discretion, ASB may bring any claim, cause of action, or dispute we file against you may be resolved in the Australian Court or in any competent court in the country where you reside that has jurisdiction over the claim.

Other

These Terms (formerly known as the Statement of Rights and Responsibilities) comprise the entire agreement between you and ASB regarding your use of our services. They supersede any prior agreements.

Suppose any portion of these Terms is found to be unenforceable. In that case, the unenforceable part will be deemed amended to the minimum extent necessary to make it enforceable. It will be severed if it can’t be enforceable, and the remaining portion will remain in full force and effect. It will not be considered a waiver if we fail to enforce these Terms. Any amendment to or waiver of these Terms must be made in writing and signed by us.

Without our consent, you will not transfer your rights or obligations under these Terms to anyone else.

These Terms do not confer any third-party beneficiary rights. You freely agree to our rights and obligations under these Terms without any enforcement.

We always appreciate your feedback and other suggestions about our services. We may use feedback and further suggestions without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.

We reserve all rights not expressly granted to you.

6. Other terms and conditions

The use of ASB can be considered a social media platform. Therefore, using ASB is subject to the obit of the country's laws in which you reside.

We are not involved or responsible for your losses when you use this ASB for trading or business or violate these Terms. You may use other platforms for your business, and you should take your responsibilities to the Tax Department, Government and the laws of the country in which you reside and do business.

We can help you to advertise your business. In exchange, you have to pay us advertising fees. The Ads fee and policy will be updated when we start accepting ads in the future.

Privacy Policy

We want you to understand what information we collect and how we use and share it. That’s why we encourage you to read our Privacy Policy. It helps you use ASB in the way that is right for you. We also explain to you how we collect, use, share and retain information. We let you know your rights and responsibilities in this policy and on ASB. There’s an example in each section for you to make our policy clear and easy to understand. It’s crucial that you know how to control your privacy.

What we collect:

We collect the personal information you provide us when registering an ASB account. It includes email, country, and created date.

You can post and share stories, send messages, comment and react to other stories, follow and unfollow others and reject other ASB users' following you on ASB. We collect and retain the content you post and share, comment and react to, follow, log in, log out and send messages to others. When you have deactivated yourself, other ASB users will not find the content you created, shared, commented and reacted to, or followed except for the messages. But when you delete your ASB account, all the stories you created and shared, your reactions, including happy and unhappy, comments, your following and follower data, and your messages with other ASB users will no longer be seen by other ASB users. ASB users cannot search for your account when you either deactivate or delete your ASB account.

For example, you reside in Australia and going to create an ASB account. When you create your ASB account, we collect your email address, your country is Australia, and created date is 2023-04-10 09:20:18. When you post or share a story, we collect your story content and the date you create or share. When you react with happy or unhappy, we collect your unique ID, the story owner’s unique ID and the date you react. All your activities will be collected under your unique ID, other ASB users’ unique ID related to your activities and the date a specific activity occurs.

How we use your information:

We use the email that you have given us to communicate with you. For example, we send you a verification email to activate your ASB account when you register an ASB account. We send you an email when you change or reset your password successfully. We send you emails about payment of a custom name, such as payment reminders, the payment received, and the custom name updated, as well as deactivating and deleting the account successfully.

To help people have a safe and secure place to share thoughts and feelings, we fight harmful conduct to protect you and other ASB users and our community. Therefore, we may use the information collected with your permission to provide a third party with jurisdiction to resolve a dispute, complaint or denunciation or to prevent malicious actions that harm you and other ASB users and our community.

For example, once you have deleted your ASB account and been accused by an ASB user of sending disruptive messages to that person or others in court. We may reveal your messages to that person with your permission in court to support you.

How your information is shared on ASB:

When an ASB user searches for and finds you or when you post, share, comment, react, follow and chat with other users on ASB, some of your information will be seen by them. They will see:

- Your avatar;

- Nickname;

- People who are following you;

- People whom you are following;

- Comments that you and them have been engaged. They also may see your comments on other posts;

- Number of reactions to your stories;

- Number of shares of your stories.

Those you have chatted with can also see the date and time your messages and their messages are sent.

Information that other ASB users cannot see from you:

- Your email;

- Your country. People in the same country as you may know your country as our News section displays stories within your country. If other ASB users who are not in the same country as you search and find you, they may not know exactly which country are you in;

- Your secret ID;

- Your created date;

- People who react and share your stories. Only you can see them.

Your rights and responsibilities in this privacy policy and on ASB:

When using ASB, you have the following rights:

- Create and share stories that do not violate our Terms and Policies;

- React to other ASB stories;

- Follow other ASB users;

- Communicate with other ASB users if they accept your chat request;

- Comment on your own posts and other posts if they accept. Otherwise, your comments may be removed by the post's owner;

- Communicate with us;

- Report ASB accounts that you think violate our Terms and Policies or the Laws and Regulations of Australia and other countries;

- Log in, log out, deactivate and delete your account.

To help us advance our mission to provide a safe and secure place for you and others to share thoughts and feelings, we need you to take the responsibilities below:

- Provide us with your accurate information;

- Keep the Secret ID we provide you in your My Profile section, and do not share it with anyone else. We may ask you to give it to us to verify your account sometimes;

- Obit our Terms and Conditions;

- Obit to your country's laws and regulations related to using social media platforms;

- Report ASB accounts that you think violate our Terms and Policies or the Laws and Regulations of Australia and other countries;

- When there is any dispute, lawsuit, complaint or denunciation related to you, when required, you have the responsibility and obligation to engage positively to assist the competent authorities in resolving the case quickly to protect you and other ASB users and our community.

We may need to update this policy from time to time to accurately reflect and improve our services for you to get a better experience on ASB. We'll notify you via email for at least 30 days when there's an available update. When the new policy is in effect, you will be bound by it.

These Terms, Conditions and Policies are in effect on 15th May 2023.
